1.     Applying for a work Permit from Within Canada

Earlier, under the temporary public policy, visitors in Canada could apply for work permits without leaving the country. This policy was introduced in August 2020 to address the shortage of labor due to COVID-19 pandemic and was extended until February 28, 2025.

On August 28, 2024 Immigration, Refugees and Citizenship Canada (IRCC) announced the immediate end of their temporary measure earlier than expected. As a result, Visitors can no longer apply for work permits from within Canada under this policy.

Current Options:

·       Apply from Outside of Canada: To obtain the work permit, a person will have to apply from their home country or any other country where they have a legal status.

·       Explore Other Work Permit Streams: Some visitors still are eligible to apply other types of work permit from within Canada, such as those under international agreements or specific programs. It’s advisable to consult with immigration professional to explore these options.

2.     Restoring or Extending Your Visitor Status:

All those whose Visitor visa are near expiring or had already expired, may apply to extend or restore it. It is important to note that the restoration can be done in 90 days. During this period, you must remain in Canada or cannot work or study until your status is restored.

3.     Applying for a Study Permit:

Transitioning from visitor status to a study permit is another option. To do this, you must obtain a Letter of Acceptance from a Designated Learning Institute (DLI) and apply for a Study Permit. The application is typically done from outside Canada. In some cases, the application can be processed within Canada and it is advisable to consult an experienced immigration professional before taking this step.

It is important to bear in mind that recent policy changes have tightened rules on study permits, including reducing the number of applications and limiting work permit for spouses of international students.

4.     If none of the above options are feasible, you may choose to leave Canada voluntary. This decision can help in maintaining a positive immigration record, which is beneficial if there are plans to apply for Canadian visas in the future.
